Acquisition and Disposition of Property - Buildings and Land

Background

The Board believes that the acquisition and disposition of buildings and land must take into consideration the educational needs of students in each community based on current and future demographics.

The Board further believes that through a strong stakeholder dialogue and consultation that we can continue to achieve the goal of providing places to learn in each community that meets the needs of each educational community.

Procedures

  1. The Board has the authority to acquire, own, and dispose of buildings and land as derived from the School Act and the accompanying Disposition of Property Regulation, and the Municipal Government Act and the accompanying Subdivision and Development Regulation.
  2. The Board authorizes the Superintendent or designate to determine the need for, or the relinquishing of need for, buildings and land through a stakeholder consultation process.
  3. Acquisition of Buildings and Land 
    1. School sites shall be acquired from the reserve land dedication provided under the Municipal Government Act, or purchased using approved division Capital Reserve funding. The Board and the Superintendent shall constitute the selection committee. The decision will normally be made by consensus of the selection committee. 
    2. Buildings will be acquired based on need through the consultation process and in accordance with Alberta Education guidelines and regulations.
  4. Disposal of Buildings and Land 
    1. The declaration of lands and buildings dedicated for division use at no cost to the division, as surplus to division need, shall require Board approval.
    2. Each sale, transfer or exchange of land titled to the division shall have Board approval.
    3. Each sale, transfer or exchange of buildings titled to the division shall have Board approval. 
    4. Each Board approved sale, transfer or exchange of land titled to the division shall comply with provincial legislation and regulations. 
    5. Each Board approved sale, transfer or exchange of building titled to the division shall comply with provincial legislation and regulations. 
  5. Criterion and Considerations 
    1. The Board and administration will consider the following factors when making decisions in regards to this policy:
      1. demographic factors,
      2. other public educational uses for school buildings,
      3. enrollment trends,
      4. student accommodation and transportation issues,
      5. whether a school on the school reserve, municipal and school reserve or municipal reserve is included in the Board’s Capital Plan,
      6. consultation with other boards with respect to their needs for the school  reserve, municipal and school reserve or municipal reserve, and
      7. any other criteria the Board considers necessary.
